HC stays termination of MGNREGA employees engaged without advertisement | | | Early Times Report Srinagar, Aug 16: The Jammu and Kashmir High Court today comes to the rescue of MGNREGA employees whose services had been asked by the government to be terminated since they were engaged without following proper procedure and without advertisement and stay the order with regard to the petitioners from Kishtwar District. As per the details available with Early Times, J&K High court today directs Rural Development and Panchayat Raj Department to continue the services of Gram Rozgar Saveks (GRS) in district Kishtwar till the next date of the hearing. In a writ petition bearing SWP No. 1645/18 titled Firdous Nabi and others was filed before the Hon'ble high court of J&K at Jammu challenging the impugned order dated 9/8/ 2018 issued by secretary RDD by virtue of which it has been order that all the engagements made under the MGNREGA scheme in contravention to the rules/ norms/ guidelines in vague and with out following due procedure of law shall be disengaged with immediate effect and further Deputy Commissi-oners of the Districts have been ordered to submit action taken report in the matter with in fifteen days. Accordingly the matter came to be listed before the ho'nble court today and justice Dhiraj Singh Thakur after hearing the arguments of the counsel of petitioner Advocate N.D Qazi was kind enough to issue notice to the respondents and meanwhile directed RDD Department to allow the petitioners to continue GRS in district Kishtwar. Advocate Arshad Majid Malik Deputy Advocate General appears on behalf of respondents. |
