JAMMU, Oct 6: A Division bench of High Court comprising Chief Justice Gita Mittal and Justice Alok Aradhe dismissed an appeal filed by the state against the judgment of Writ Court whereby Writ Court quashed the premature retirement of Abdul Gani Mir, Mineral Supervisor, I/C District Mineral Officer, Bandipora, Industries & Commerce Department. Dismissing the appeal the Division Bench observed that in bunch of writ petitions had quashed the orders of compulsory retirement passed by the appellants, merely on the basis of registration of First Information Reports, by an order dated 22-12-2016 passed in SWP No.1947/2015. Admittedly, the aforesaid order has been upheld by the Division Bench of this Court and the State Government has preferred a Special Leave Petition before the Supreme Court.
However, the Special Leave Petition has been withdrawn and the orders passed by this Court have been implemented. In view of the preceding analysis, we do not find any ground to differ with the view taken by the learned Single Judge. In the result, the appeal is dismissed along with connected IA, DB observed.
