DB directs respondents to check use of plastic bags | PIL on preservation of Parks | | Early Times Report JAMMU, Nov 28: Division Bench of the State High Court Comprising Chief Justice Gita Mittal and Justice Sanjeev Kumar directed respondents to take strict measures to ensure that there is no violation of the prohibition for use of plastic bags in the State. While directing respondents, Division Bench observed that in pursuance of the order dated 24th October 2018, S.F. Qadiri, learned Amicus Curiae has informed that the respondents have identified eleven gardens in the status report dated 20th October 2018, however, on a physical inspection; he was able to find only six gardens in existence. Three of the gardens namely Mali Training School Rajbagh, Flower Mandi Rajbagh and New Kashmir Park were nonexistent. DB directed the Director of the Department of Floriculture to assign a senior officer, who shall accompany the Amicus Curiae for inspection of these three gardens. Division Bench observed that this report also makes a reference to the littering on the public parks. This again underlines the imperative necessity of framing By-Laws under the Environment Protection Act and the Rules of 2016 which would provide fines for littering of the public spaces. DB further directed the State of J&K to strictly enforce the prohibition regarding the plastics in the State and to prevent its very entry. The action plan in this regard as well as action taken report shall be filed within six weeks from today. The respondents shall continue to make every effort to improve the available public parks and gardens. |
