Court rejects bail of Gulhati brothers | | | Early Times Report JAMMU, Feb 23; Sub-Judge Jammu Pawan Kumar Sharma rejected bail application of Sandeep Gulhati and Shalinder Gulhati who have been arrested by the Crime Branch in fraud case. The court after hearing senior advocate Sunil Sethi for the applicant, CPO Crime Jawaid Ahmed Khawaja, senior PO Puja Nijhon for the State and senior advocate P N Raina with Advocates Y E Tak and Rajat Gupta for the complainant observed that this court has no doubt in mind that there is a prima facie case against the applicants as they have taken and cheated the complainant of more than 12 Crores. The nature and gravity of accusation is also serious. There may be punishment upto seven years but the behaviour, conduct and character of the accused speaks itself that accused have not relented where the money of more than 12 Crores have gone and is still untraceable. It also appears to me that in the event of being granted bail, there are chances of accused repeating the offences because if they have signed two different contracts pertaining to the same property for two different amounts on the same date, with a father and son, they can do so with any other third person, the court observed. The judge observed that he is of the view that bail in this case would certainly amount to denial of justice to the complainant. The accused cannot take lame excuse that transaction is civil in nature and run away with more than 12 crores without facing justice. |
