Omar, NC misleading people on Art 35A, 'Accession': Brig Gupta

Jammu, Mar 30: Continuing with its time-tested ploy of polarisation and arousing public passions for seeking votes, Omar Abdullah and other leaders of his party are misleading the people by hiding facts and creating doubt in the minds of people regarding Article 35A and state's integration with the Union of India, accused Brig Anil Gupta, State Spokesperson of Bharatiya Janata Party.
The inconsistant stance of NC with reference to 35A and using it merely as a tool to suit the personal aspirations of Abdullahs has been badly exposed by now, particularly among the youth of Kashmir.
The other Kashmir-centric parties have also criticised the blog written by Arun Jaitely, Union Finance Minister and eminent lawyer. The criticism is full of rhetoric, lacks substance and is based on half-truth. A false narrative is being created to mislead the people about Article 35A, on the pretext that it is mere continuation of Maharaja Hari Singh's Notification of 1927. "What is being hidden from the people is that original notification of 1927 also had two other categories namely Class III and Class IV. While Class three citizenship was granted on the basis of "ijazatnama" and "rayatnama", Class IV citizenship was given to owner of those companies who were registered within the state and contribute to economic stability of the state. These two categories were deliberately omitted by the Kashmiri leadership to deny benefit to members of a particular community," stated Brig Gupta.
Even there was no gender discrimination in the Maharaja's notification. It was introduced later by the vested interests with a certain motive. Such discriminatory provisions need to be done away with.
The case is subjudice and is being examined by the Supreme Court, whose verdict will have to be accepted by one and all, said Brig Gupta. Despite that NC and valley -centric political leadership is creating a scare among the people.
Jammu based leadership of NC is ridiculing the Dogra pride by creating fear that due to their short-stature, jobs would be snatched by much taller Punjabis and Jats. "Dogras are proud of the fact that short-statured General Zorawar Singh extended the state's frontiers up to Tibet and Hunza," claimed Brig Gupta. Countering another claim of Omar that tinkering with Article 35A will open debate on accession of J&K to Union of India, Brig Gupta said that there was no inter-connection between Article 35A and accession. "The accession of state took place in October 1947 to the Dominion of India when the Maharaja signed the IOA. Thereafter, J&K continued to be governed by "Jammu and Kashmir Constitution Act 1939". It finally merged with the Democratic Republic or the Union of India in 1954 when the state's Constituent Assembly ratified the accession," according to Brig Gupta. Article 35A is a separate provision of the Constitution of India which is debatable because it was not debated and passed by the Parliament of India.
"It is also true that the economy of the state is affected due to the reluctance on part of big corporate houses to invest in the state. Not only that qualified super specialist doctors, scientists and professors of eminence and technocrats are unwilling to serve in the state due to uncertainty of their future as well as of their families. It is all due to discriminatory nature of Article 35A," asserted Brig Gupta.
