Jammu, July 26: Justice Tashi Rabstan of J&K High Court (Jammu Wing) while expressing displeasure over the non-filing of Action Taken Report (ATR) by the Deputy Commissioner Jammu with regard to encroachment of 34 kanals state land falling under Khasra No.86 min situated at village Rakh Kharoon, tehsil Akhnoor, has directed the DC to file the ATR within two weeks or appear in person on the next date of hearing. The directions were passed in a writ petition filed by Satish Kumar Sharma, a resident of Rajpura Camp, tehsil Marh, seeking directions to the Divisional Commissioner Jammu, DC Jammu, SDM Akhnoor and Tehsildar Akhnoor to evict Gopal Dass, son of Parkash Chand, of Rakh Kharoon who has encroached 34 kanals state land and also resorted to green felling in the said land. When this petition came up for hearing, Advocate appearing for the petitioner submitted that on December 28, 2018 the court had taken a serious note of the felling of green trees by the encroacher and also encroachment of a huge chunk of state land measuring 34 kanals with the connivance of local revenue agency. Advocate further submitted that the Court had directed DC Jammu to submit a report with regard to action taken against Gopal Dass for felling the green trees standing over the state land and steps taken regarding his eviction from the state land. After considering the submissions of both the sides, Justice Tashi Rabstan while expressing his displeasure over the non-filing of the ATR directed DC Jammu to file the status report in terms of order dated December, 28, 2018 within a period of two weeks failing which he will have to appear in person on the next date of hearing i.e. August 28, 2019. |
