JAMMU, Oct 25: A Bench of the Supreme Court of India comprising Justice L Nageshwara Rao and Justice Hemant Gupta has dismissed the Special Leave Petition (SLP) filed by University of Jammu against the judgment of the Division Bench of J&K High Court which had upheld the judgment passed by the single judge whereby the writ court of J&K High Court had allowed the writ petition filed by Priyanka Arya wife of Dr Satyapriya Arya of Rohini, New Delhi who despite recommendations in her favour by the Selection Committee had been denied appointment by the Jammu University for the post of Assistant Professor in the Department of Sanskrit under Open Merit Category and instead of appointing her the Jammu University had re-advertised the post vide Advertisement Notice No.Adm/TW/ C&R/17/2053-73 dated November 30, 2017 without finalizing the selection process earlier initiated vide Advertisement Notice No.Adm/TW (C&R)/16/1642-92 dated April 18, 2016 in which Priyanka Arya was a candidate and was shown at S.No1 in the merit list. The writ court had further quashed re-advertisement notice dated November 30, 2017 and had directed the Jammu University that there is no requirement to fill up the same post for which recommendations had already been made in favour of Priyanka Arya. The writ court had further directed Jammu University to act upon the recommendations made by the selection committee in accordance with law.
After hearing the counsel for Jammu University, the Bench of the Apex Court headed by Justice L. Nageshwara Rao did not find any merit in the SLP preferred by the University of Jammu and dismissed the same in limini. The Bench in the open court observed that there is no ground in the SLP warranting interference and the same is accordingly dismissed.
It may be recalled that in an approved for reporting Judgment the First Puisne Judge of the J&K High Court Justice Rajesh Bindal had quashed the re-advertisement Notice dated November, 30, 2017 and had directed the Jammu University to act upon the recommendations made by the selection committee in favour of Priyanka Arya who was recommended for appointment but later the Jammu University did not issue the appointment order and decided to re-advertise the same. The Judgment of the Single Judge was assailed by the Jammu University before a Division Bench comprising Justice Dhiraj Singh Thakur and Justice Sindu Sharma and the Division Bench after hearing Advocate Wasim Sadiq Nargal appearing for Jammu University had dismissed the same in limini finding no merit in the same and the Jammu University thereafter preferred SLP (Special Leave Petition) before Apex Court which too dismissed the same in limini.
With the dismissal of the SLP by the Apex Court the decks are cleared for the appointment of Priyanka Arya against the post of Assistant Professor in the Department of Sanskrit, University of Jammu.
