Court reject bail of two in NDPS | | | Early Times Report
Srinagar, Nov 23: 4th Additional Sessions Judge Srinagar Haq Nawaz Zargar rejected the bail application ofFarooq Ahmad Khan S/O Ghulam Nabi Khan and Mehraj ud din Mir S/O Ghulam Nabi Mir Both Residents of Saida Kadal, Srinagar who was allegedly booked by the police NDPS Act. While rejecting bail application, 4th Additional Sessions Judge Srinagar Haq Nawaz Zargar observed that Perusal of the report reveals that the accused persons are the habitual offenders and it has been mentioned that the accused no.1/ petitioner no.1 had already been arrested in similar case and the challan is pending in some court. This means that petitioner no. 1 is a repeated offender and in my opinion does not deserve any concession of bail at this stage when the investigation is in progress. Further it has also been mentioned in the report that both the accused persons are the habitual offender, as such they do not deserve any concession of bail at this stage. It is important to note that this offence directly affects the society at large and the cry of society is to tackle these offenders with iron hands. When the Court is called upon to exercise discretionary jurisdiction, then balance has to be struck between the personal liberty of an accused and ultimate health and tranquility of the society. The apprehension of the prosecution has a weight, that if the applicants are enlarged on bail, it is likely that they may involve themselves in such like activities. Court further observed that in order to curb this menace, some coercive measures need to be taken by all the stake holders, we the present generation could not sit back and see in our surroundings, the future of next generation being ruined by few enemies of humanity. With these observations Court rejected bail application. --(JNF) |
