Court reject bail of alleged heroine smuggler | | | Early Times Report Jammu, Dec 4: Principal Sessions Judge Samba MA Chowdhary Rash Pal Singh S/O Pritam Singh R/O Upper Gadi Garh Maha Kali Nagar Mohalla, Jammu from whose possession 7 gram heroine was recovered. According to the police case that police report asserting therein that the applicant has been arrested in a case registered at Police Station Ghagwal vide FIR No. 95/2019 U/Ss 8/21/22 NDPS Act, as he is a narcotic smuggler who smuggles the drug and sells the same to the people/youth to make them addicts; that the applicant was arrested on 24.10.2019 by concerned police when 7 gms of Heroin (Chitta) was recovered from his possession. Principal Sessions Judge Samba MA Chowdhary after hearing Adv Ashwani Khajuria for the applicant whereas Public Prosecutor Jawad Khawaja for the state observed that quantity of contraband recovered from the applicant falls in intermediate quantity, therefore bar of section 37 NDPS Act is not applicable to the instant case. The offence of which the applicant has been accused carries punishment of 10 years imprisonment and fine of Rs. 1 lakh. Given to the severity of punishment, the offence is serious in nature. Otherwise also the menace of trade and use of narcotic drugs and psychotropic substance has become alarming to society in general and young generation in particular. This menace requires to be curbed with a heavy hand as it is eating into vitals of the polity. The case of applicant is at initial stage of investigation and in my considered opinion, having regards to the facts and circumstances of the case, particularly the serious nature of offence, the applicant is not entitled to grant of bail at this stage.
