Court rejects bail of retd CRPF cop in NDPS case | | | EARLY TIMES REPORT
JAMMU, Jan 21: Principal Sessions Judge Samba rejected the bail application of one retired CRPF personal allegedly involved in NDPS Act. According to the police case that the applicant has been arrested in a case registered at Police Station Ban Brahmana vide FIR No 03/2020 U/S 8/20/25 NDPS Act; that the applicant was arrested on 08.01.2020 by concerned police when 120 gms of Charas was recovered from his possession. Principal Sessions Judge Samba Mohd Akram Chowdhary after hearing Public Prosecutor Jawaid Khawaja for the UT observed that the quantity of contraband recovered from the applicant falls in intermediate quantity, therefore bar of section 37 NDPS Act is obviously not applicable to the instant case. The offence of which the applicant has been accused carries punishment of 10 years imprisonment and fine of Rs 1 lakh. Given to the severity of punishment, the offence is serious in nature. The case of applicant is at initial stage of investigation and in Court’s considered opinion, having regards to the facts and circumstances of the case, particularly the serious in nature of offence, the applicant is not vitiated to grant of bail at this stage. |
