Court rejects bail of Mumbai based Heroin smuggler | | | EARLY TIMES REPORT
JAMMU, Feb 13: Additional Sessions Judge Jammu Tahir Khurshid Raina today rejected the bail application of one Santosh Kumar resident if East Thani Mumbai from whom Bus Stand police on December 31, 2019 seized 180 grams of heroin. While rejecting bail, Additional Sessions Judge Jammu Tahir Khurshid Raina after hearing Adv Aadil Mazoor Beigh for the applicant whereas APP Suresh Kumar Sharma for the UT observed that it is to put on record that this legislation called the NDPS Act, is not an ordinary legislation but was based on the cry and concern of the whole world through UNO and it is in that backdrop, India being signatory to International treaties and conventions , enacted this law to address global menace of drug addiction and drug trafficking in the society. Same is reflected from the preamble of the Act which speaks that an Act to make stringent provisions for the operation of drugs and narcotic substances has been enacted. Court further observed that while balancing them in the backdrop of the stage of the trial, quantity of contraband seized from the accused which is on the higher side of the intermediate category, gravity of the crime, level of accusation against the accused being drug peddler and the degree of grievous impact of drug menace on the society, I do not feel legally convinced to exercise discretion of grant of bail to the accused at this stage, rather rejection of it is the only fate he meets at this stage. With these observations Court rejected bail application. JNF
