Khalida, Muzaffar Shah, Kamaal free to move anywhere: Govt | | | EARLY TIMES REPORT
SRINAGAR, Mar 2: Jammu and Kashmir High Court on Monday reserved its verdict on an appeal filed by Sheikh Abdullah’s daughter Khalida Shah and son Sheikh Mustafa Kamaal against the dismissal of their petition against ‘detention’ by the government following annulling of Article 370 of the constitution and bifurcation of the state into two Union Territories by the central government on August 5. The appeal has been also filed by Khalida Shah’s son Muzaffar Shah. Hearing the appeal, a Division Bench of Justice D S Thakur and Justice Sanjeev Kumar reserved its order with the observation that all kind of security be removed from these leaders. The observation followed arguments by the counsel for the parties. The counsel appearing for the appellants contended that his clients were not being allowed to move even on the corridor of the house. Senior Additional Advocate General, representing the government submitted that there was no security at the houses of appellants except their personal security. He said that the appellants are free to move anywhere. To settle the dispute, the court asked both the parties to withdraw all kind of security which as per the appellants are not allowing them to move freely from their residence. Last year, a single bench of the court had dismissed the petition challenging alleged house arrest of Mustafa Kamal, the NC additional general secretary and brother of party president Farooq Abdullah and ANC chief Begum Khalida Shah along with her son Muzaffar Shah. The single bench while dismissing their petition had granted them liberty to prove their house arrest before the appropriate forum by filing appropriate proceedings. Pertinently, the court’s single bench had observed that their petition was not maintainable and is unnecessary after communication submitted by SSP Srinagar stated that the petitioners have neither been put under house arrest at 10, Moulana Azad Road nor their liberty curbed. In their petitions, the leaders said they have been under unlawful detention since August 5. |
