JAMMU, July 4 (JNF): A Division Bench of J&K High Court Comprising Chief Justice Gita Mittal and Justice Vinod Chatterji Koul while hearing a Public Interest Litigation, after hearing Adv Srishti Paul Mengi for the PIL directed Divisional Commissioner, Jammu shall examine the matter and ensure that no brick kiln is permitted to be run in Reasi without compliance with the requirements of the Jammu and Kashmir Brick Kilns (Regulations) Act, 2010, any other applicable statute and an action taken report shall be filed in this regard before the next date of hearing.
In the PIL it has been submitted that on 25th October 2010, the Jammu and Kashmir Brick Kilns (Regulations) Act, 2010 made it compulsory for existing brick kilns to apply for grant of licence. Almost ten years have passed since the passing of the law, however the same is not being implemented by the respondents. The grievance in the writ petition is that the respondent no. 4 is running the brick kiln without fulfilling the requirements as required under the Jammu and Kashmir Brick Kilns (Regulations) Act, 2010.
