CBJ gets anticipatory bail applications of accused dismissed | | | EARLY TIMES REPORT JAMMU, Jan 23: The Crime Branch Jammu has strongly contested anticipatory bail application of Manjeet Singh resident of EQ 54 Pacca Bagh Jalandhar Punjab and got the bail dismissed after convincing the Court of 3rd Addl. Sessions Judge Jammu on merits of the case in case FIR No. 21/2003 U/S 420, 467, 468, 471/RPC P/S Crime Branch Jammu for his involvement in managing a fake PRC for claiming the residential status of J&K. The instant case was registered in Crime Branch Jammu in 2003 for his involvement in manipulating a fake PRC (Permanent Resident Certificate) as resident of J&K in his favour. The charges against the accused were proved and subsequently charge-sheet was produced in the Court of CJM Jammu in September 2006. However, during the trial of the case, presence of the accused was sought by the Court but the accused did not appear before the Court which led to adjournment of the Court. The accused kept on evading his presence before the Court. Consequently proceeding U/S 512 CrPC were initiated against the accused for effecting his arrest. The accused remained at large and kept constantly evading his arrest by changing his locations frequently. However, Crime Branch Jammu kept on constantly chasing and raiding his hideouts. The accused moved application for his anticipatory bail before the Court of 3rd Additional Sessions Judge, Jammu. The CB-Jammu contested the bail application and after listening to the arguments the Court observed that provision of anticipatory bail under section 497-C J&K CrPC is meant for those innocent persons who have been wrongly roped in a false and frivolous case and protection of law is required to be provided to them and the bail application was dismissed. |
