JAMMU, Apr 22: In a much publicized case of spurious drugs wherein some children died in Ramnagar in which complaint was filed seeking prosecution of accused for offences under sections 16, 17A(e), 18(a)(vi) 18 (a) (i), read with sections 27(a), Section 27(d) 36AC of the Drug & Cosmetics Act, 1940 on account of allegations that after it came to fore during investigation that infant mortalities in Ramnagar area of District Udhampur occurred due to consumption of medicine/drugs, CJM Jammu Amarjeet Singh issued bailable warrants against the proprietors of a pharmaceutical company and others. Haryana, Virinder Kumar Jandyal, S/O Ram Ditta, R/O Lakkar Mandi, Janipur, Jammu and Mohinder Singh, S/O Late Bharat Singh, R/O W.No 11, Ramnagar, Udhampur. This complaint sated that medicine/drugs which were purchased from one retail Drug store under name of Jamwal Medical Hall being operated by accused no. 11 namely Mohinder Singh, on 17.02.2020 samples were also lifted from Jandial Pharmaceuticals, Mohalla Paharian, Jammu who is whole sale license holder and distributor and accused no. 7 herein - for analysis to Chandigarh where the drug sample namely "Coldbest-PC Syrup", Batch no. DL5201 was found to be "not of standard quality" and during further investigation, it was found that the drug in question manufactured by accused no. 1 Digital Vision manufacturing company is not only of "not standard quality" but also adulterated drug. Further chain of events as unfolded in the complaint would show that accused Virinder Kumar Jandial sold the brand of medicine in question to accused no. 11 namely Mohinder Singh who is proprietor of Jamwal Medical Hall - Main Bazaar Ramnagar, District Udhampur. It is also alleged that accused Parshotam Goyal, Konic Goyal and Manic Goyal are partners of accused firm Digital Vision, the manufacturing company of drug in question who is accused no. 1 herein. In all, as already mentioned hereinabove - 11 accused are being sought to be prosecuted for the aforesaid offences in this complaint. CJM Jammu Amarjeet Singh Langeh after going through the complaint observed that needless to say, drug products including drug in question that are intended for use of public at large must meet their standards of safety and quality consistent with the provisions of Drugs and Cosmetics Act. In the complaint in hand, there is prima facie evidence of infraction of provisions of aforesaid Act and hence this complaint under sections 16, 17A (e), 18(a)(vi) 18 (a) (i), read with sections 27(a), Section 27(d) 36AC of the Drug & Cosmetics Act, 1940 for which cognizance seems to have already been taken by this court on 01.07.2020 and process issued against accused. CJM further observed that having regard to the gravity of the offences involved and seriousness of the allegations, it is directed that accused to be summoned through issuance of bailable warrants in the amount of Rs 20,000 each for appearance before this court on next date of hearing so that after performing preliminary formalities, matter can be committed to the Special Court for trial. Ld. counsel for complainant shall ensure that particulars of all accused with respect to the Districts in which they are presently residing be furnished to this court within four days from today so that the bailable warrants can be sent to concerned SSP(s) for execution at the earliest.
