CJM rejects Royal Singh's application seeking medical examination | Nagar Singh house firing case | | EARLY TIMES REPORT
JAMMU, Apr 26: In a much publicized Nagar Singh house firing case, CJM Jammu Amarjeet Singh Langeh rejected the application seeking medical examination through registered medical practitioner and body check-up of one Royal Singh who is stated to be an under-trial. It is alleged in the application that on 17th/18th of April, 2021, applicant was brought on remand by police station Gandhi Nagar, Jammu for interrogation and when his father met him, he found him injured as a result of beating that applicant received in 3rd degree torture/mental torture by non-applicant police station etc. As per police report, pursuant to receipt of an information through PCR-Jammu that some unidentified, persons, 5/6 in number with their faces covered with masks travelling in 2/3 vehicles, fired on residential premises of one Ch. Nagar Singh S/O Koula Ram R/O H.No. 33/AD Gandhi Nagar, Jammu. Based on this report an FIR No. 91/2021 for offences under sections 307/120-B/149 of IPC and section 3/25 of Arms Act was registered with the non-applicant police station and investigation started. It is alleged that during course of investigation it came to fore that applicant herein hatched a criminal conspiracy from inside jail with the help of driver of Kote Bhalwal Jail and other co-accused. CJM Jammu Langeh after hearing both the sides observed that bare perusal of photocopies of the record of medical examination of applicant Royal Singh in police hospital Jammu would show that he was examined by doctor concerned on three occasions. Firstly on 17.04.2021, then on 21.04.2021 and finally on 22.04.2021 and he was found fit at the time of examination on all three occasions. While applicant aggressively asserted that he has been subjected to torture during police custody, the record of his medical examination as aforesaid, conducted on three occasions, indeed only counters this assertion of applicant. In the medical record annexed with police report there is not even an oblique insinuation of physical torture on the person of applicant. This in my considered opinion clinches the issue arising in this application. With these observations, CJM observed that the allegations in the application seem to be far short of prima facie veracity and this application therefore does not merit acceptance. (JNF)
