| Court rejects bail application of alleged charas smuggler | | |

Udhampur, Aug 10: Additional Sessions Judge Udhampur SC Katal rejected the bail application of alleged Charas Smuggler namely Ram Krishan from whom Police Station Chenani recovered 193 grams charas and registered FIR NO 103/2021 u/s 8/20 NDPS Act.
While rejecting the bail application, Additional Sessions Judge Udhampur SC Katal after hearing APP Himanshu Gupta observed that the investigation of the case in hand is still incomplete. The recovery of charas makes the case an exceptional one where liberty of accused need be curtailed so the investigation be completed at the earliest. Moreover, the possibility cannot be ruled out that the accused will abscond if enlarged on bail, thereby, frustrate the course of investigation. The allegedly contraband seized from the possession of the applicant/accused is of substantial quantities though it is intermediate quantity, as such, its distribution may adversely affect the interest of society at large. So far as personal liberty of the applicant is concerned it will be sufficient to say the investigation of cases under NDPS Act cannot afford to derail/ hamper on the pretext of personal liberty of an individual. With these observations, the Court rejected the bail application. (JNF) |
