Encroachment of 640 kanals of Wular lake, DB seeks ATR | | | Early Times Report SRINAGAR, Sept 1: In a PIL protection of the Wular lake and for the removal of all hutments and encroachment within the catchment area in and around the said lake. A Division Bench of Jammu & Kashmir High Court Comprising Chief Justice Pankaj Mithal and Justice Sanjay Dhar directed respondents to submit action-taken-report as to how 640 kanals of land have been encroached upon and as to what action the authorities have taken against such encroachments. DB further directed the respondents to inform the manner in which this Rs. 200/= crore provided is sought to be spent for the conservation and management of the Wular lake. When the PIL Came-up for hearing, Division Bench observed that the order dated 10.8.2018 enumerates the issues to be taken up in this petition vis-a-vis i) De-weeding in Wullar-Mansbal lakes; ii) removal of encroachment on the banks of lakes; iii) Conservation and development of Wullar-Mansbal lakes; iv) Creation/deputation of staff under land management wing; v) Formulation of Integrated Development Plan, Master Plan and determination of jurisdiction of Wullar-Mansbal Authority; and vi) Conservation and development of Wullar-Mansbal lakes. During the course of the proceedings, the Chief Executive Director, Wullar Conservation and Management Authority; Union of India through Ministry of Finance, New Delhi; and Ministry of Environment and Forests, Government of India, New Delhi, were added as respondents 7, 8 and 9 respectively. Amicus Curiae has placed on record newspapers reports, wherein it has been stated that 640 kanals of Wular lake have been encroached upon illegally. At the same time it has also been reported that Rs. 200/= crore have been provided for the conservation and management of Wular lake. In view of the above reports, DB call upon the respondents to submit action-taken-report as to how 640 kanals of land have been encroached upon and as to what action the authorities have taken against such encroachments. The respondents shall also inform the manner in which this Rs. 200/= crore provided is sought to be spent for the conservation and management of the Wular lake. DB further directed that the action-taken-report be submitted within three weeks. DB also directed respondents to ensure that no garbage from any village situate on the banks of the Wular lake is dumped into the lake area. Further it is made clear that henceforth this PIL will remain confined to the conservation, management and development of the Wular lake. —JNF |
