Court rejects bail of teacher for allegedly supplying arms to terrorists

JAMMU, June 9: Special Judge NIA Ashwani Sharma has rejected the bail application of one Zahir Abbas Naik who is teacher by profession allegedly involved in supplying arms and ammunition to terrorists.
The Special Judge NIA after hearing APP Anil Magotra for the UT observed that the police of P/S Kishtwar has registered FIR 178/2020 for the offence under sections 13/18/19/20/23/39 UA(P) Act, 7/25 of Arms Act after receiving information from reliable source that some over ground workers of HM are giving shelter to some militants and are also providing day to day necessities to such militants.
After receiving this information a search party of SOG along with the local police cordoned the area of Nai Basti Char Pathar tehsil Drabshalla District Kishtwar and arrested two accused Mohammad Hanief Butt and Gulzar Ahmad Butt and during investigation accused Zahir Abbas Naik was also been taken into custody by the SOG.
His disclosure statement was recorded by the police of P/S Kishtwar. Following this one pistol along with two magazines and 18 rounds of 9 mm were recovered at the instance of accused/applicant herein. During the course of hearing counsel for the applicant submitted that the applicant is a teacher by profession having great respect in the society and his prolonged detention may jeopardize his entire career.
The APP appearing for the UT submitted that the applicant is involved in unlawful activities by aiding, providing and transporting the arms and ammunitions to the terrorists organization who have created terror amongst the peace loving citizen of the state by killing the persons.
Special Judge NIA while rejecting the bail application observed that the embargo contained u/s 43-D (5) is attracted in the present case. By the act of the accused/applicant herein the unity, integrity, security and sovereignty of country shall be endangered as the applicant has disclaimed, questioned and disrupted the sovereignty and territory of India with intention to secede the territory of the UT of J&K from the union of India.
The judge said that if the applicant will be enlarged on bail the confidence of the general public upon the courts shall be shattered as such, in the larger interest of the state and taking into consideration the security of the state, the applicant does not deserves the concession of bail at this stage, particularly when the material witnesses are yet to be examined.
