HC stays SMC executive committee meeting | | | Sanjay Pandita Early Times Report
Srinagar, Mar 29: The Jammu and Kashmir High Court has stayed the scheduled Executive Committee of the Srinagar Municipal Corporation. The Coram of Justice Sindhu Sharma observed: “In the meanwhile, subject to objections and till next of hearing before the Bench, the Meeting Notice dated 24th March, 2023 is stayed.” “The members of the executive committee were elected on 19th June, 2021 and their tenure has already expired, therefore, the vacancies had to be filled by holding of elections of councilors as per the Act,” the Court said. The petitioners had challenged the meeting notice. “The contention of learned counsel for the petitioners is that this Meeting Notice could not have been called by the respondents, as the tenure of the members of the committee has ended in terms of Rule 52 of Jammu and Kashmir Municipal Corporation (Procedure and Conduct of Business) Regulations 2021, which provides as under:-‘Tenure of Members of the Standing Committee:-One half of the members of the Standing Committee shall retire on the completion of one year from the date of its constitution. For the first year, the members, who shall retire, shall be selected by draw of lots before the expiration, in such manner as the Chairman of the Standing Committee may determine.’” The councilors forum of the SMC had smelt a rat in the scheduled meeting . Taking to the social media, the president of the Srinagar Corporators Front Danish Bhat had said “Calling this meeting in so much haste and without retiring the members and holding fresh elections clearly suggests there is a nasty plan behind it and if sources are to be believed then it’s just an attempt to clear some huge multi-crore bills.” He had said the “contractors hovering in Church lane” and has been seeking New Delhi’s intervention into the SMC allegedly “shady” working. |
