Early Times Report JAMMU, July 20: Jammu & Kashmir and Ladakh High Court's Srinagar Wing upheld the termination of Judicial Officer Mohammad Yousuf Allie, who fraudulently secured a Reserved Backward Area (RBA) certificate. The Division Bench, comprising Justice Atul Sreedharan and Justice Mohan Lal, considered the RBA certificate in J&K UT as equivalent to a caste certificate elsewhere, enabling reservation benefits for those holding it. After hearing both sides, the Bench found that the petitioner had fraudulently obtained the RBA certificate, as indicated in the Deputy Commissioner's report dated January 30, 2018. The petitioner did not challenge this report before any judicial forum, and a subsequent report on July 7, 2018, was also deemed non-est by the Court. Based on the above findings, the Division Bench concluded that the petitioner's entry into service was through fraudulent means. Consequently, depriving him of a departmental inquiry did not violate Article 311 of the Constitution, as upheld by the Supreme Court. With these observations, the Division Bench dismissed the petitioner's plea, upholding the termination of the Judicial Officer. |
