HC upholds J&K Housing Board's land acquisition | | | Early Times Report JAMMU, Oct 6: In a significant legal development, the Division Bench of the Jammu & Kashmir and Ladakh High Court, comprising Justice Sanjeev Kumar and Justice Puneet Gupta, upheld the land acquisition proceedings initiated by the J&K Housing Board (JKHB). The court allowed the Letters Patent Appeals (LPAs) filed by the JKHB and set aside the previous judgment of the Writ Court. The case revolved around the acquisition of a substantial piece of land measuring 3271 kanals and 6 marlas in village Meen Charkan and village Bari, Tehsil, and District Samba. This acquisition was initiated by the J&K Housing Board to create a housing colony to address the pressing need for housing accommodation. The judgment directed the Collector of Land Acquisition, J&K Housing Board, to continue with the land acquisition proceedings, starting from the stage at which they were previously quashed. Furthermore, the Collector was instructed to expedite the process and pass the final award without any unnecessary delay. One of the key aspects of the judgment was the determination of compensation. The court ruled that the compensation should be calculated based on the value of the land in the year 2023. This decision aligns with the provisions outlined in the State Land Acquisition Act.
