High Court Modifies Interim Order, Allows Government to Proceed with Appointment of 1395 Panchayat Secretaries | | | Early Times Report
Jammu, Apr 29: Justice Wasim Sadiq Nargal of the Jammu & Kashmir and Ladakh High Court has modified the interim order in the panchayat secretary selection process, permitting the government to move forward with the appointment of 1395 candidates. During the hearing, Advocate Wasim Akram Qazi represented the petitioner, while AAG Amit Gupta stood for the Union Territory. Justice Nargal observed that instead of actively participating in the selection process, the petitioners had sought to obstruct it through misrepresentation and baseless apprehensions. The High Court noted that the interim orders had halted the entire selection process, causing a shortage of staff in the department. Justice Nargal emphasized that the petitioners lacked standing to challenge the selection process, as there was no preferential fundamental right for their regularization. Considering the situation, Justice Nargal deemed it unnecessary to continue the interim directions, which were adversely affecting the interests of the selected candidates. Therefore, the interim orders issued previously were vacated, and the official respondents were directed to promptly conclude the selection process. However, the Court clarified that the appointment of the selected candidates would remain subject to the final outcome of the ongoing writ petitions. This decision paves the way for the government to proceed with the appointment of 1395 panchayat secretaries, bringing relief to the candidates and addressing the staff shortage in the department.
