CAT directs UT to convene DPC/PSC, for their substantive promotion to posts of ARTO | | | Early Times Report JAMMU, Sept 25: A Bench of Central Administrative Tribunal comprising B Anand and Rajinder Singh Dogra directed UT of Jammu & Kashmir to to convene the DPC/PSC and to place the cases of the applicants before the DPC/PSC for their substantive promotion to the posts of Assistant Regional Transport Officers retrospectively from the date they were made in-charge of the post, with all consequential benefits. This judgment has been passed in an application filed by Mohd. Saleem and Shammi Kumar being aggrieved of inaction of respondents in convening the DPC/PSC for the substantive promotion of applicants to the posts of Assistant Regional Transport Officers retrospectively from the date they were made in-charge of the aforesaid post. CAT after hearing both the sides observed that it clear that the minimum qualification for departmental promotion to the post of ARTO is only seven years of service as Motor Vehicle Inspectors. In other words, no technical qualification has been prescribed for promotion to the post of ARTO. The applicants herein were promoted as Motor Vehicle Inspectors w.e.f. the year 2003, as such, by the year 2010, the applicants had attained the required service of seven years for promotion as ARTO. Hence, the applicants are eligible for consideration of their cases for regularization of their promotion to the post of ARTO. With these observations, CAT allowed the Original Application and directed the respondents to convene the DPC/PSC and to place the cases of the applicants before the DPC/PSC for their substantive promotion to the posts of Assistant Regional Transport Officers retrospectively from the date they were made in-charge of the post, with all consequential benefits. —JNF |
