BJP high command in no hurry to nominate 5 MLAs | | | Early Times Report
Jammu, Jan 8: Exactly three months have passed since the declaration of the results of the Jammu and Kashmir Assembly elections, but no decision has been made regarding the nomination of five MLAs. Highly placed sources have stated that neither the BJP-led government at the Centre is in a hurry to make a decision on this issue, nor has the National Conference-led government headed by Omar Abdullah shown any interest. According to the Jammu and Kashmir Reorganization Act, 2019, the Lieutenant Governor has the authority to nominate five members to the Legislative Assembly. “The BJP high command has yet to show any interest in the nomination of five MLAs to the Jammu and Kashmir Assembly,” sources said, adding that a decision in this regard will be taken only after the announcement of the Rajya Sabha elections. Sources also mentioned that the BJP high command is adopting a ‘wait and watch’ policy in Jammu and Kashmir and will not take any hasty decisions on this matter. It is important to note that the results of the 90 seats in the Jammu and Kashmir Legislative Assembly were declared on October 8, 2024, and it was announced that five MLAs would be nominated before the newly elected members took their oaths. As per the Jammu and Kashmir Reorganization Act, 2019, the Lieutenant Governor is tasked with nominating five MLAs to the Legislative Assembly. The Lieutenant Governor of the Union Territory of Jammu and Kashmir may nominate up to two members, one of whom must be a woman, from the Kashmiri Migrants community to the Jammu and Kashmir Legislative Assembly. Explanation: For the purposes of this section, the term “Migrant” shall have the same meaning as assigned to it in clause (e) of Section 2 of the Jammu and Kashmir Migrant Immovable Property (Preservation, Protection, and Restraint on Distress Sales) Act, 1997. A displaced person from Pakistan-occupied Jammu and Kashmir refers to any person who, due to the setting up of the dominions of India and Pakistan or due to civil disturbances or the fear of such disturbances in any area of the then State of Jammu and Kashmir (currently under Pakistan’s occupation) during the years 1947-48, 1965, and 1971, had left or been displaced from their place of residence in such areas. This also includes the successors-in-interest of any such person. |
