Court rejects anticipatory bail plea in rape case

Jammu, Sept 24: The Fast Track Court, Jammu, has dismissed the anticipatory bail application of Ajay Kumar (38), a resident of Gangyal, accused of repeatedly raping a woman under the pretext of offering her a job.
Presiding Officer Amarjeet Singh Langeh rejected the plea filed in connection with FIR No. 95/2025 registered under Section 376 of the Indian Penal Code at Police Station Gangyal. The Court observed that custodial interrogation of the accused was imperative to recover alleged electronic evidence, including nude photographs and videos said to have been taken of the prosecutrix.
The prosecution opposed bail on grounds that the accused could destroy crucial digital evidence. According to the FIR, the prosecutrix—estranged from her husband and in need of employment—came in contact with the accused through Facebook. She alleged that he spiked her drink, rendered her unconscious, and raped her at a rented house in Gangyal, later blackmailing her with photographs and videos.
The Court noted that the allegations made out a prima facie case of rape, describing the offence as “grave and heinous,” and held that Ajay Kumar had “failed to make out a case for grant of anticipatory bail.”
Dismissing the petition, the Court clarified that its observations were limited to the bail proceedings and would not prejudice the trial of the case once the investigation is completed. (JNF)
