| ACB Court lets off 5, orders charges against beneficiary, ex-ZEO | | Fake Certificate Job Scam | | Early Times Report
Jammu, Apr 15: In a significant order in the fake qualification certificate case linked to the School Education Department in Budgam, the Court of Additional Special Judge, Anti-Corruption, Srinagar has ordered framing of charges against Abdul Latief Khan and Gh Hassan Hakeem, while discharging Abdul Aziz Malla, Ghulam Nabi Shah, Ravinder Kumar Raina, Hakeem Noor Mohammad and Ghulam Qadir Misgar from the case arising out of FIR No. 16/2017. The case relates to allegations that Abdul Latief Khan secured engagement as a Rehbar-e-Taleem teacher in Education Zone Hard Panzoo, Budgam in the year 2000 by producing a fake and forged 10+2 marks certificate and later succeeded in getting his services regularised. The court noted that the prosecution material prima facie showed that Khan was not eligible for appointment at the relevant time and that the marks certificate relied upon by him was later found to be fake during verification by the Board of School Education. The court also found prima facie material against Gh Hassan Hakeem, the then Zonal Education Officer, Hard Panzoo, observing that despite clear directions in the regularisation order requiring verification of original academic testimonials before giving effect to the order, the process was allegedly carried forward without compliance. The court held that at this stage there was sufficient material to proceed against the beneficiary and the concerned ZEO. However, the court held that no prima facie material existed against Abdul Aziz Malla, Ghulam Nabi Shah, Ravinder Kumar Raina, Hakeem Noor Mohammad and Ghulam Qadir Misgar. It observed that these accused had only released salary or dealt with the file in the ordinary course and the record did not show that it was their responsibility to verify the educational credentials of the beneficiary. The court further noted that the fake nature of the marks certificate surfaced only in 2019 after the Anti-Corruption Bureau sought verification from JKBOSE. Proceedings against Gh Nabi Dar and Abdul Rashid Mir had already abated due to their death. The court accordingly discharged accused No. 4, 6, 7, 8 and 9 from offences under the J&K Prevention of Corruption Act read with Sections 120-B, 420, 468, 471 and 201 RPC, and cancelled their bail bonds and sureties. The prosecution was conducted by Special Public Prosecutor Wajahat Jamil. Abdul Latief Khan was represented by Advocate Hasnain Khawaja; accused 3, 4, 6 and 7 were represented by Advocate I.A. Sofi; while accused 8 and 9 were represented by Advocate M.A. Pandit. The matter has now been listed on May 18, 2026 for framing of charges against Abdul Latief Khan and Gh Hassan Hakeem. (JNF) |
