JAMMU, Sept 22: The Principal Sessions Court, Shopian, has sentenced Bilal Ahmad Seh to life imprisonment and imposed a fine of ?1 lakh after convicting him under Section 302 RPC for the murder of Kamal Adfar in a 2019 case arising out of an orchard dispute.
The sentence was awarded by Principal Sessions Judge, Shopian, Mehmood Ahmad Chowdhary in FIR No. 19/2019 registered at Police Station Zainapora. The case relates to the killing of Kamal Adfar on April 8, 2019 at Nismhall, Humhuna Nagbal.
According to the prosecution, an altercation took place between the parties in connection with their orchards. During the incident, the accused persons allegedly caught hold of Kamal Adfar, following which Bilal Ahmad Seh inflicted a knife blow on his chest. Adfar sustained serious injuries and was shifted to Zainapora Hospital, where he later succumbed.
Police initially registered the case under Sections 341 and 302 RPC, while Sections 147, 148, 307, 109, 506 and 34 RPC were subsequently added during investigation.
During investigation, police prepared the site plan, recorded statements of witnesses, seized the blood-stained clothes of the deceased and conducted the post-mortem examination. The prosecution also relied upon the recovery of the weapon of offence, which was allegedly recovered from an orchard at Nismhall pursuant to the disclosure of the accused.
During trial, the prosecution examined 16 witnesses out of 18 listed in the challan, while the evidence and certificates of the remaining two expert witnesses were admitted by the defence without cross-examination. The prosecution case was supported by ocular, medical and forensic evidence, besides evidence regarding recovery of the weapon.
After examining the evidence, the court held that the prosecution had proved beyond reasonable doubt that Bilal Ahmad Seh had inflicted the fatal knife injury upon Kamal Adfar. The court observed that the injury had penetrated deep into the chest and caused damage to vital organs, including the heart and lungs, and held that the nature and manner of the injury established the requisite intention to cause death.
The court accordingly convicted Bilal Ahmad Seh under Section 302 RPC and sentenced him to imprisonment for life along with a fine of Rs 1 lakh.
