Early Times Report JAMMU, Oct 14: The Special NIA Court, Jammu, has declared a Rajouri resident, who is reported to have crossed the Line of Control and subsequently taken shelter in Pakistan-occupied Kashmir, a proclaimed offender after he failed to appear before the Court despite repeated legal proceedings. Special Judge Prem Sagar passed the order in NIA case RC-07/2022/NIA/JMU while allowing an application seeking to declare Mushtaq Ahmed Mir, son of Ghulam Rasool Mir and resident of Kashmiri Mohalla, Thanamang, Darhal, Rajouri, a proclaimed offender under Section 84 of the Bharatiya Nagarik Suraksha Sanhita. According to the execution report submitted by the Station House Officer, Police Station Darhal, the accused had allegedly crossed the Line of Control during 1995-96 and joined militancy. The report further stated that he was residing in Pakistan-occupied Kashmir. The Court was informed that non-bailable warrants had already been issued against the accused but remained unexecuted. Thereafter, a proclamation was issued on July 20, 2026, directing the accused to appear before the Court. Despite publication of the proclamation in newspapers, including The Statesman and Daily Excelsior on August 13, the accused neither surrendered nor appeared before the Court. Special Public Prosecutor K. S. Pathania represented the NIA. After examining the prosecution material and execution reports, the Court observed that the accused was allegedly absconding and deliberately avoiding the legal process. The Court further noted that there was no immediate prospect of securing his arrest despite efforts made by the investigating agency. Accordingly, Special Judge Prem Sagar declared Mushtaq Ahmed Mir a proclaimed offender and directed that a copy of the order be forwarded to the Government Ranbir Press, Jammu, for publication in the next issue of the Official Gazette.
