Husband acquitted from allegations of abetting his wife to commit suicide | | | Jammu, Feb 14 (JNF): Principal Sessions Judge Poonch Jaffer Hussain Beigh today acquitted one Arif Hussain Shah of Potha- Poonch wfacinmg trial for the allegations of abetting his wife to commit suicide as prosecution miserably failed. Principal Sessions Judge Poonch Jaffer Hussain Beigh observed that in her statement that she (wife of accused) was treated with cruelty by the accused but there is no explanation on the record in her statement by what manner the accused treated her with cruelty court observed that there is no evidence on record led by the prosecution to say the cause of the death of the deceased because doctor's opinion is silent and FSL report has not been called and thus it cannot be concluded that the deceased died due to any poisonous substance. With these observations the Court acquitted the accused from the charges leveled against him. As per police case the statement of the deceased Mobina Kouser recorded by ASI Munshi Khan where-in the deceased has stated that she was married to the accused for the last 7 years and out of this wedlock two children were born. The accused is a labourer. on 10.10.2010 at about 10.30 am the accused went to the house of her uncle Zubair Hussain Shah where she had come for about two months after being annoyed with the accused. The accused compelled her to take back but she was bent upon not to accompany him and even her uncle Zubair Hussain Shah also advised her to go to her home along with the accused. Instead she she went in the bath room and consumed some poisonous substance because the accused was treating her with cruelty. She was brought to the Surankote hospital. After recording the statement of Mobina Kouser, the same was produced before the Police Station Surankote where FIR No.168/2010 for commission of offence u/s 309 RPC was registered. Meantime Mobina Kouser was referred then to Rajouri Hospital where she died at evening. After completion of the investigation offence u/s 306 RPC was established against the accused person. |
