| Bail denied to accused in kidnapping and rape of minor | | | Early Times Report
Jammu, Mar 1 Chief Judicial Magistrate Budgam Kamlesh Pandita has rejected the bail application of Muzaffar Ahmed Waggy who was arrested by the police in case of kidnapping and rape with a minor.
According to the police case that accused was allegedly involved in case under FIR NO 34/2015 of P/S Budgam for the commission of offence u/s 376/363 & 120-B RPC and it was further revealed that the on February 17, 2015 father of the prosecutrix lodged a written complaint that on February 12, 2015 his minor daughter had gone to the hospital for treatment but did not return and he tried hard to find the whereabouts of his daughter but came to jnow that his daughter was enticed and abducted by Muzaffar Ahmed Waggy with the assistance of other accused person and on this police registered and FIR and started investigation and recovered the girl. Chief Judicial Magistrate Budgam Kamlesh Pandita observed that the offence committed by the accused person is heinous offence and the offence not only against he individual but against the society at large and while considering the bail application different yardsticks are to be taken into account the gravity of the offence, its impact on the society at large. With these observations Court rejected the bail application. (JNF) |
