HC directs ASCOMS to admit petitioner in MBSS Course under NRI Quota | | | Early Times Report
Jammu, Sept 24: In a petition filed by Sidhant Kalsotra seeking a direction to ASCOMS to admit him to 1st Year MBBS Course against one of the 07 seats belonging to NRI quota for the Session 2015, Justice Tashi Rabstan of J&K High Court Jammu Wing directed ASCOMS to admit the petitioner to MBBS Course against one of the left over seats meant for NRI quota for the Session-2015 well before September 30. After hearing both the sides, Justice Tashi Rabstan observed that indisputably, the notification-in-question came to be published in the newspaper on 22/08/2015 when the aspiring candidates came to know about filling-up of MBBS seats against NRI quota, therefore, 07 days time can be reckoned from a preceding date. "Further, the respondents have not disputed about the fact that the petitioner had shown his willingness to the said course in the late evening of 28/08/.2015, court observed and added meaning thereby the petitioner had accorded his willingness well before the completion of 07 days period. Meantime ASCOMS has not disputed that private respondents possess lesser merit than the petitioner. With these observations Court allowed the petition and directed ASCOMS to admit the petitioner to MBBS Course against one of the left over seats meant for NRI quota for the Session-2015 well before 30th September, 2015. According to case of the petitioner is that the petitioner was awarded 99 marks in the Common Entrance Test for admission to MBBS and BDS Course (Management Quota) for the Session 2015 and he was ranked 98 in the merit list. The said test was conducted by Acharya Shri Chander College of Medical Science and Hospital (ASCOMS). Since there were only 50 seats in the management quota, the petitioner, therefore, could not make it to the select list. Meantime with a view to fill-up these 07 vacant MBBS seats of NRI quota from amongst the candidates of General Category from Management Quota, ASCOMS issued Notification No.ASCOMS/Adm/DP/1542 dated 21/08/2015, which was published in Newspaper on 22/08/2015 which read -the candidates who have secured more than 75 marks in Common Entrance Test and are willing to pay the fee equivalent to NRI Category in Indian currency may submit their application forms within seven days from the date of issuance of notification. It was submitted that only on 28.08.2015 in the evening the petitioner came to know about the same as he was in Srinagar and he immediately conveyed his willingness to the office of ASCOMS through e-mail. It is averred that respondent No.2 without considering the claim of petitioner completed the selection against these 07 left over seats of NRI quota. (JNF) |
