Allows restaurant to run on its land? | GDA misleading Judiciary-II | | Early Times Report Srinagar, Oct 19: Gulmarg Development Authority (GDA) which has always remained in news for its failure to act against the blue-eyed people, influential hoteliers has again been caught on the wrong foot. The authority continues to mislead not only the Government, but the Judiciary as well which is hearing a Public Interest Litigation (PIL) from last few years vis a vis illegal constructions in Gulmarg. The GDA inspite of the fact that it marked several structures as illegal has failed to demolish them and instead demolished some makeshift tin sheds and seized old hotels constructed more than 4 decades back. The GDA even failed to demolish a restaurant which was constructed on the land owned by GDA itself. Details available with Early Times reveal that Gulmarg Development Authority (GDA) marked several illegal structures , restaurants, hotels with white paint as " GDA Land" many weeks back , but the Chief Executive Officer (CEO) of GDA never ordered for their demolition inspite of the fact that these structures (hotels, restaurants) are constructed on the land owned by GDA. In a drive during early this month GDA team marked a restaurant with white paint which owned by Grand Mumtaz Group, but it was never demolished. The restaurant was also sealed , but the seal was opened within few hours only…. The restaurant located adjacent to Grand Mumtaz hotel was constructed on the Govt land owned by GDA, but even after being marked as illegal, GDA CEO failed to demolish it and instead demolished tin sheds. As already reported, Cable Car Corporation (CCC) which looks after "Gumlarg Gandola" operations has also been busy with carrying construction material to Kongdoori using Gandola cable car. Sources say that development of a park at Kongdoori had been allotted to a blue-eyed person without inviting tenders and against the High Court orders and Early Times had carried a detailed report on this issue few months ago. The Cable Car Corporation (CCC) by bypassing all the codal formalities had allotted the work to one Mohammad Ashraf who owns a restaurant at Kongdoori. Pertinent to mention that Jammu and Kashmir High court last year banned all constructions in famous ski resort at Gulmarg in north kashmir and directed the state government to transfer few Gulmarg development authority officials for failing to check illegal activities. A division bench comprising Justices M H Attar and Ali Mohammad Magrey directed the authorities to ensure that all construction activities in Gulmarg be stopped and vehicles carrying construction material to the resort be seized. The court order banning construction and transportation of construction material came following reports of large scale illegal construction in the garb of minor repairs and without proper permission from the has authorities. "Deputy Commissioner as also Senior Superintendent of Police Baramulla and Gulmarg Development Authority (GDA) shall forthwith enforce the above direction and ensure no construction activities is undertaken at Gulmarg till further orders from the court," reads the high court order… The court order came in the wake of serious allegations made in a report which prima facie indicated grave irregularities committed in allowing the people to renovate and repair their structures. "GDA which cannot demolish illegal structures constructed on its own land , how can people believe that this authority will demolish other structures constructed on Forest land around Gulmarg. This is a nexus between CEO and hoteliers" says Farooq Ahmad a local resident of Tangmarg. |
