HC directs Health Deptt to take appropriate steps | Issuance of LPC to Dr Choudhary | | Early Times Report JAMMU, Feb 14: The High Court of Jammu and Kashmir at Jammu has directed the health department to take the appropriate steps regarding issuance of Last Pay Certificate (LPC) in accordance with the rules preferably within a period of four to six weeks in favour of petitioner Dr. Uzma Choudhary. Through the present writ petition, the petitioner Dr. Uzma Choudhary has sought direction to Director Health services to forward application form of petitioner for the post of Registrar in the discipline of Ophthalmology to Principal GMC&H for being interviewed, pursuant to Advertisement Notification No.JMC/ES-1/109/253 dated 26.05.2017, issued by Principal GMC&H; directions to interview petitioner for the post of Registrar in discipline of Ophthalmology, notwithstanding the failure of Director Health Services to forward the application form of the petitioner in time; direction to relieve the petitioner, in case the petitioner succeeds in selection process for the post of Registrar in the discipline of Ophthalmology, pursuant to Advertisement Notification No.JMC/ES-1/109/253 dated 26.05.2017. Counsel for the petitioner stated that the petitioner is the member of the Jammu and Kashmir Health and Family Welfare (Gazetted) Services and has applied for the post of Registrar in Medical Education Department in Government Medical College, Jammu. Since the case of the petitioner was not considered and form was not forwarded by the Director Health Services Jammu to the Principal, Government Medical College Jammu, the petitioner was forced to file the writ petition. Following Court directions, the form of the petitioner was forwarded, she was interviewed and selected and appointed and, therefore, the cause of action for filing the present writ petition has now become infructuous. However, as a corollary, the petitioner seeks that her Last Pay Certificate (LPC) should be forwarded to the Principal, Government Medical College, Jammu so as to enable her to get regular salary. Justice Ramalingham Sudhakar after hearing the submissions directed that the appropriate steps should be taken by the authority concerned in accordance with the rules applicable, preferably within a period of four to six weeks from the date of receipt of certified copy of this order. |
