Srinagar, June 29: Justice MK Hanjura while deciding two habeas corpus petitions quashed the detention order passed by the District Magistrate, Shopian with a further direction to release the person of Tawseef Ahmad Mir S/o Late Bashir Ahmad Mir R/o Chakoora, Pulwama, Tehsil & District Pulwama and order of detention bearing No. 22/DMA/PSA/DET/2017 dated 17th of November, 2017, passed by District Magistrate, Anantnag, as extended vide Government order No. Home/PB-V/491 of 2018, dated 17th of May, 2018.
While quashing the detention orders, Justice MK Hanjura observed that there is no definite material to show that the requirements of section 13 of the Jammu & Kashmir Public Safety Act, 1978, (in short the Act), requiring the grounds of order of detention to be disclosed/communicated to the person affected by the order has been complied with. With these observations High Court quashed the detention order of Tawseef Ahmad Mir and Nisar Ahmad Khan. |
