Ring Road affected farmers appeal PM

Jammu, Feb 2: The affected farmers of Jammu and Srinagar Ring Road projects have appealed Prime Minister Narendra Modi to address the issue of disparity in payment of compensation to the affected farmers by National Highway Authority of India (NHAI) through J&K Government. Framers have urged that NHAI pays 4 times more compensation than market value of land in other states and in J&K not even market value of land is paid
In a joint press statement, affected farmers have said that inspite of PM Modi inaugurating the Ring Road projects in Jammu & Srinagar around May last year no physical progress has taken place in the work.
" Not even 10 % of the work has been taken up since PM came to J&K last year in summer for inaugurating Ring Road projects. The reason is affected farmers are not being paid fair compensation and the work is not able to be taken up. This project is marred by controversies and authorities are not ready to address the same. We appeal PM to probe why new Ring Road projects are not been taken up and question the Govt ? " said Dr Raja Muzaffar Bhat RTI activist & Convener of Ring Road Land Owners Welfare Committee (Srinagar / Jammu). As reported already the affected farmers of Kashmir valley and Jammu formed a joint coordination committee last month to press for their demands. The farmers say that Jammu & Kashmir state continues to follow J&K Land Acquisition Act 1934 which is an 85 year old law promulgated by Maharaja Hari Singh.
"The Congress lead United Progressive Alliance (UPA-II) in the year 2013 enacted more progressive and democratic law called Right to Fair Compensation & Transparency in Land Acquisition, Rehabilitation and Resettlement Act (RFCTLARR Act 2013). Inspite of the fact that Congress was in coalition Government with National Conference in Jammu & Kashmir in the year 2013, RFCTLARR 2013 was not ratified by J&K Government and the ultimate sufferers are the farmers in J&K " said G A Paul President of the Ring Road affected farmers Kashmir
"Right to Fair Compensation & Transparency in Land Acquisition, Rehabilitation and Resettlement Act (RFCTLARR Act 2013) focuses on providing not only compensation but rehabilitation and resettlement as well. In rural areas compensation paid to affected people is 4 times more the market value of land and property and in urban areas this compensation is double. J&K is a land deficit state with mere 3 kanals agriculture land holding which is 1 hectare plus (20 kanals) in rest of country.
Instead of paying J&K affected farmers 5 to 7 times more compensation than market value of land , our land is being snatched and we are paid 10 to 50 times less than the market value as stamp duty rate in J&K state especially in Jammu and Budgam districts is very less " said O P Khajuria Senior Kisaan leader of Jammu
To construct two Semi Ring Roads in Jammu & Kashmir, National Highway Authority of India (NHAI) is acquiring huge amount of land (10,000 Kanals plus) in few districts of Jammu and 5 districts of Kashmir valley. Budgam and Jammu districts are the worst effected districts in J&K. Funds have already been provided under PMs Development Programme (PMDP). NHAI is not ready to pay the affected people / farmers compensation what they pay in other states of India. The main issue is that RFCTLARR Act 2013 has not been extended to J&K nor has J&K state enacted a similar law which would have same provisions.
" Private Negotiation is a provision in J&K Land Acquisition Act 1934, but we were never called for private negotiations. NHAI says this is a compulsory acquisition. Neither they adhere to J&K Land Acquisition Act provisions nor are they paying us as per central law and in between farmers of J&K are getting sandwiched. We will fight this tooth and nail and will not give our land to NHAI " said S C Dubey senior leader of Ring Road affected farmers committee
