Infinite Achievers hail Court's decision on e-cigarette | | | Early Times Report
Jammu, Mar 24: 'Infinite Achievers', a consumer awareness group striving for safe alternative for smoking welcomed the Delhi High Court stay which suggest that e-cigarettes cannot be regulated under Drugs & Cosmetics Act. The petitioners argued that the prohibition seriously affects the person right to choose a safer alternative as compared with combustible cigarettes. The petitioner also relied to the report of the Drugs Consultative Committee and various RTI response wherein the Drug Controller General of India has recommended that "E Cigarettes are not covered under the definition of Drug and therefore do not come under the purview of Drugs and Cosmetics Act, 1940. E Cigarettes therefore cannot be regulated under the provisions of the said Act." Sunit Narula, General Secretary, Infinite Achievers said, "The stay has implications on the advisory of the Ministry of Health's to States (August 2018). The bans implemented on ENDS by many States may come under purview as they have no legal framework under which the e-cigarettes have been banned. |
