Early Times Report Jammu, May 8: The J&K High Court has quashed the detention of a Pulwama youth under the Public Safety Act (PSA). Justice Ali Mohammad Magrey quashed the detention of Mohammad Maqbool Wani, a resident of Ladhoo, in Pampore, Pulwama, in a petition filed by his father Ghulam Qadir Wani. Maqbool was detained under the PSA on July 21, 2018. "The detaining authority has failed to mention in the detention order about the petitioner's right to make representation which constitutes an infraction of a valuable constitutional right guaranteed under Article 22(5) of the Constitution of India as also of the right under Section 13 of the Jammu and Kashmir P.S Act, 1978, which renders the detention order as invalid and deserves to be quashed," the court observed. |
