| Removal of Article 370 and bringing Jammu and Kashmir on par with other states is the only viable solution to the issue. Article 370 has been the biggest impediment to integration of J&K State into Indian Union. A big Kudos to PM Modi and Home minister Amit Shah for moving a bill proposing bifurcation of the state of Jammu and Kashmir into two union territories -- Jammu and Kashmir division and Ladakh. There has been a long pending demand of people of Ladakh, to give it the status of a Union Territory to enable them to realize their aspirations. With the historic proposals, the BJP has fulfilled its poll promise. On May 12, BJP President Amit Shah had said that the Article 370, which gives special powers to Kashmir, will be scrapped if Narendra Modi is elected as prime minister again. Now India is integrated perfectly as one nation as it will be now one nation and one constitution and one law. There has been a clamorous demand for the abrogation of article 370 of the constitution which grants a special status to Kashmir, the demand has been fanned and intensified by the role of Pakistan in J. & K. The article was enacted with much displeasure to India's founding fathers such as Sardar Patel and Babsaheb Ambedkar. It was a very controversial topic as the region is an international hotspot and the state is the only Muslim-majority state in India. Nehru's promise that Article 370 was a temporary provision and will get eroded over a period of time has turned out to be a chimera. Sardar Patel the Iron Man of India - silent, strong and pragmatic with a complete hold on congress party organization - rightly credited with creating a unified India by integrating 565 princely states in it - he would have included Kashmir also in it if allowed to do so by Nehru. The only blot on him was the insinuation that he failed to protect his beloved Bapu. The slur only hastened his end in Dec 1950. Article 370 granted special autonomous status to Jammu and Kashmir, while Article 35A, incorporated into the Constitution in 1954, provides special rights and privileges to the citizens of the state. There is no doubt that scrapping of Article 370 is the solution to all problems of people facing in Kashmir. Article 370 of the Indian constitution is an article that gives special status to the state of Jammu and Kashmir. The article is drafted in Part XXI of the Constitution: Temporary, Transitional and Special Provisions. The Constituent Assembly of Jammu and Kashmir, after its establishment, was empowered to recommend the articles of the Indian constitution that should be applied to the state or to abrogate the Article 370 altogether. After the J&K Constituent Assembly later created the state's constitution and dissolved itself without recommending the abrogation of Article 370, the article was deemed to have become a permanent feature of the Indian Constitution. The provision was drafted in 1947 was Sheikh Abdullah who argued that Article 370 should not be placed under temporary provisions of the Constitution. According to Article 370, the state's residents live under a separate law including those related to citizenship, property ownership, fundamental rights due to which other citizens from Indian states cannot purchase a property in Kashmir. Moreover, the Central government cannot also not declare a financial emergency in the state of Kashmir. Article 370 has been a subject of public debate and Jammu and Kashmir political leaders have warned that any proposal of removing it will add tensions in the valley. The whole country was in favour of the Modi government and it was not a small majority but a huge mandate. It is clear that although Article 370 was included in the constitution as a temporary provision, either no sincere effort was made over the last 70 years to revoke it, or the efforts were sabotaged by pro-separatists and residents of the Valley. A misconception had also been spread that if these articles are removed, people from other states will purchase most of the prime land and the local residents will become landless and homeless. The J&K economy is dependent on agriculture, horticulture and tourism. The younger generation is not interested in agriculture and horticulture, which require hard labour and do not provide expected returns. The tourism industry, which generates employment for a large number of young Kashmiris, lies in shambles. More than 300,000 Kashmiri Pandits were forced to leave the Valley and are now settled in Jammu, raising its population, while the population of Kashmir has decreased. Now when the Articles 370 and 35A are removed, the government should make detailed plans to develop the state. Once peace is restored, tourism will rise and generate employment and the resentment of young people will end slowly and steadily. |
