Prosecution failure leads to acquittal in rape case | | | Early Times Report
Jammu, Aug 8: Principal Sessions Judge Reasi Kamlesh Pandita acquitted one Karan Singh S/o Jodh Singh R/o Sarhi Tehsil Bhamagh District Reasi facing trial in rape case as prosecution failed to prove the case. Principal Sessions Judge Reasi Kamlesh Pandita after hearing both the sides observed that it is trite that there is no rule of law that the testimony of the prosecutrix requires corroboration in material particulars. If in a particular case the court finds it difficult to accept the version of the prosecutrix, it may look for evidence which may lend assurance short of corroboration to her testimony. In the facts of the case, this court finds it difficult to accept the version of the prosecutrix which is not only highly improbable rather suggest that it is the product of falsehood at every step. Consequently the statement of prosecutrix is not reliable. For the reasons prosecution has failed to prove the charges against the accused. Accordingly, challan is dismissed as not proved. The accused is acquitted of the charges under Sections 376, 342 of the RPC. --(JNF) |
