Court rejects bail of two in murder case | | | Early Times Report JAMMU, Aug 26: Principal Sessions Judge Reasi rejected the bail application of two accused namely Lacho Devi and Rajinder Singh facing trial in murder case. Court after hearing both the sides observed that in the present case, there is no dispute that the accused persons have been charged for the offences punishable under Sections 302/304-B/34 RPC read with Section 30 Arms Act. In this case as already discussed that the case is based mostly on the statement of the complainant and recovery of the weapon of offence thereafter. The complainant has deposed against accused persons in line of statement recorded under section 164-A crpc. Other witnesses whose statements are yet to be recorded are almost 18 in number and are also important witnesses when the life of an close relative is done away with. Therefore, in view of the above stated reasons I do not think accused persons deserve discretion of court at this stage. The offence alleged to have been committed by the accused are heinous and entail punishment of death or life sentence. Unless and until all the witnesses are examined in the case, the court cannot come to the conclusion that there appears no reasonable ground for believing that accused are guilty of an offence punishable with death or imprisonment for life. The net result of aforesaid discussion is that bail application of the applicants/ accused persons deserve no concession and is accordingly rejected. |
