Unlike SAC, new watch dog to have full jurisdiction over public administration, to be equipped with own prosecuting agency | Govt to replace shut SAC with all powerful new anti- graft body | | Early Times Report Jammu, Nov 1: With the formation of the Union Territory and winding up of the State Accountability Commission- the government is likely going to come up with an anti-graft body with more powers and more jurisdiction. As per the sources, this new anti- graft body which will replace the SAC in the union territory of Jammu and Kashmir will have the jurisdiction over the public administration, unlike the SAC which had no control over the public administration of the elsewhere state and it was virtually rendered as a toothless tiger. According to highly placed sources within the dispensation, the government has held a high level meeting over the issue wherein it was extensively discussed that how this new anti- corruption body would be equipped with all necessary powers. One of the top officials told Early Times that within 15 to 20 days, the major development is likely to witnessed in which this anti- corruption force would be accorded the rights to function sans any hindrance. An official in the dispensation divulged that the reason to wind up the SAC was that there were scores of amendments made by successive regimes in the SAC Act which resulted in exclusion of the public administration from its jurisdiction. However, said the official, the new body will have a full fledged jurisdiction over the public administration. There are also hints being given that this new body would be given a semi-autonomous status, and proper infrastructure which includes its's own investigating agency, prosecuting agency and inquiry agency. In the past the SAC chairman had intimated the then PDP- BJP government that he would resign if SAC continues to remain a virtual toothless tiger- unable to take action against the cases of corruption and misuse of the official position by the helmsmen. The government then undertook no measures aimed at giving SAC a prosecuting agency under which a public prosecutor could carry the case further. In terms of Section 4 of the Jammu and Kashmir Accountability Commission Act, the appointment of Chairperson and the Members was to be made by the Governor on the recommendation of a Committee consisting of Chief Minister, Speaker of Legislative Assembly, Chief Justice of State High Court, Law Minister and Leader of Opposition in the Legislative Assembly. In September, 2015, Governor NN Vohra, in exercise of the powers vested in him under Section of the Jammu and Kashmir Accountability Commission Act, 2002, appointed Justice Bashir Ahmed Khan as chairperson and Justice JP Singh and Justice BA Kirmani as members of the Jammu and Kashmir Accountability Commission for five years. The SAC had remained defunct for the last seven years because all its members had completed their term of office. |
