Defunct consumer forums: Govt blames centre | HC seeks details by Jan 29 | | Early Times Report Srinagar, Dec 22: The State High Court has directed government to file an affidavit by January 29, indicating the steps taken for ensuring constitution of State Consumer Commission and District Consumer Forum "for mitigating the miseries of the litigants by or before the next date of hearing." A Division Bench of the high court comprising Justices Ali Mohammad Magrey and Dhiraj Singh Thakur passed the orders after Feroz Ahmad, Deputy Advocate General, submitted that the Government is in active consideration of the Constitution of State Consumer Commission, District Consumer Forum and "the only impediment is notification of the rules by the Central Government." He further submitted that the matter is in active consideration of the Government and the progress will be reported by or before the next date. "Let the respondents file affidavit indicating the steps taken for ensuring constitution of these commissions for mitigating the miseries of the litigants by or before the next date of hearing," the court said and posted the matter for consideration on January 29. On previous hearing, the High Court had directed Secretary Food Consumer Affairs & Public Distribution (FCA&PD) and Secretary Law to appear in person if they failed to notify by December 18 re-constitution of J&K Consumer Disputes Redressal Commission and District Consumer Forums for disposing of complaints and appeals pending before these panels. The court had directed the officials to finalize the issue and report compliance by submitting notifications on reconstitution of the Commissions and Forums. The court had observed that on November 13 it had directed the Chief Secretary to inform it within a week about the steps taken for setting up the Commissions and Forums for the two UTs of J&K and Ladakh. The Commission and the Forums were winding up as Jammu and Kashmir Re-organization Act, 2019 was implemented in J&K on October 31. At least 2,500 cases are said to be pending before the Commission. |
