Farooq Abdullah's sister, brother challenge dismissal of plea against 'detention' | | | Early Times Report
SRINAGAR, Dec 23: Jammu and Kashmir High Court on Monday issued a notice to government, seeking its response to an appeal filed by Sheikh Abdullah's daughter Khalida Shah and son Sheikh Mustafa Kamaal against dismissal of their petition against 'detention' by the government following annulling of Article 370 of the constitution and bifurcation of the state into two union territories by the central government on August 5. Last month, a single bench of the court had dismissed the petition challenging alleged house arrest of Mustafa Kamal -- the NC, additional general secretary, and brother of party president Farooq Abdullah -- and ANC chief Begum Khalida Shah along with her son Muzaffar Shah. A division bench of Chief Justice Gita Mittal and Justice Sindhu Sharma issued the notice, calling for response by the government within three days after hearing the counsel for petitioners. Before the court's single bench, Police had submitted two communication before the court which were addressed to Additional Deputy Commissioner, Srinagar wherein it was stated that all the three political leaders have neither been put under house arrest nor their liberty curbed or jeopardized. The single bench while dismissing their petition had granted them liberty to prove their house arrest before the appropriate forum by filing appropriate proceedings. Lawyer representing the trio submitted before the Division Bench that the authorities have misled the court with regard to present position of the appellants as neither they're being allowed to move outside nor anybody is being allowed to meet them. He urged the court that all the three leaders be brought before the court "to ascertain the truth". |
