Zojilla tunnels constructions done in integrated manner: GoI, HC closes PIL

Srinagar, Jan 30: Jammu and Kashmir High Court has closed a Public Interest Litigation, seeking its directions for the construction of Zojilla tunnel (s) for all-weather connectivity to Ladakh, observing that the authorities have already taken up the project.
The directions by a division bench of Justices Ali Mohammad Magray and Dhiraj Singh Thakur followed submissions by Tahir Majid Shamsi, Assistant Solicitor General of India (ASGI), that the instant Public Interest Litigation has been unnecessarily filed by the petitioner as the authorities have already formulated the proposal for construction of tunnel(s) at Z-Morh and Zojila and that the same is being undertaken by the National Highways & Infrastructure Development Corporation Limited (NHIDCL).
He contended that the construction of the tunnels was aimed at giving all weather connectively to the Kargil/Leh region and that the project is being undertaken in an integrated manner by all concerned agencies.
“In view of the aforesaid stand taken by the learned Assistant Solicitor General of India, we feel that there is no requirement of issuing any directions, as sought by the petitioner in the present Public Interest Litigation, as the concerned authorities have already taken up the project of construction of tunnels at the relevant places so as to ensure all weather connectivity to the Kargil/ Leh region,” the court said and closed the PIL.
The petition—Mohammad Ismail, a resident of the area, had sought directions to command the authorities to compete the Zojila Tunnel construction on priority basis and start construction immediately without any further delay to avoid any further sufferance to the general masses of Ladakh region and all those who are staying over there.
He had also prayed for the directions for distributing the Zojila Tunnel project in favour of more than two companies to complete the work on fast track basis by working on both sides of the tunnel for immediate completion of the project.
