| HC quashes detention order issued under PSA, criticizes DM Jammu | | | Early Times Report
Jammu, Mar 20: A single bench of High Court today quashed the detention order issued by District Magistrate Jammu under Public Safety Act (PSA) against Bunny Gupta of RS Pura.
Justice Sanjeev Kumar has also criticised the District Magistrate, Jammu for passing the detention order in a callous manner.
The HC order said," When ordinarily criminal law is sufficient to take care, resorts to preventive detention are to be avoided. The callousness with which liberty of a citizen has been curtailed coupled with manner in which the order of detention has been sought to be defended speaks volume about the manner in which the citizens of this country are dealt with by those who are enjoined to protect the life and liberty of the citizens of this country”.
The HC delivered the order in a petition filed against the detention order issued by DM. The HC order further reads, “Without saying much I allow this petition and quash the order of detention impugned in this petition. The respondents are directed to release the detenu forthwith". Advocate Anmol Sharma appeared for Bunny Gupta.
