Court rejects bail of police cop, other in NDPS | | | Early Times Report
JAMMU, Apr 27: 3rd Additional Sessions Judge Sunit Gupta today rejected bail applications of Gurcharan son of Romal Singh of Shiv Nagar Udhampur and Shubam Gupta son of Yashpaul Gupta of Hospital Road Near Pandav Mandir near Udhampur arrested by police in an NDPS case . According to police case that on 14-04-2020, a police party from Police Station Bagh-e-Bahu led by ASI Madan Lal along with his subordinates was on patrolling duty at National Highway Narwal. During patrolling they had intercepted a Santro Car bearing registration No. PB08BH-4662 and during checking it was found that the said vehicle was driven by Gurcharan and one more person namely Shubam Gupta was also accompanying him. During the personal search of both the persons 6 grams of heroin like substance was found to be recovered from the possession of Gurcharan Singh and besides that about 60000 cash amount was recovered from him, whereas about 7 grams of heroin like substance and cash of Rs 91000 was recovered from accused Shubam Gupta. As such prima facie the offence under section 8/21/22/NDPS Act were found to be committed by the accused persons the FIR No.39/2020 was registered with police station Bagh E Bahu and the accused persons were arrested by the said offences after complying the mandatory provision. APP Sanjay Kohli opposed the bail application and said that that the accused Gurcharan Singh who happened to be a police Constable is under suspension and earlier also he was arrested in case vide FIR No 96/2016 u/ss 8/18/62 NDPS Act of Police Station Reasi and under FIR NO 355/2019 u/ss 8/21/22 NDPS Act. Whereas the accused Subham Gupta was also earlier arrested in case FIR No 395/2018 u/s 8/21/22 NDPS Act and FIR NO 398/18 u/s 309 RPC and FIR No 04/2019 u/s 8/21/22 NDPS Act. 3rd Additional Sessions Judge Jammu Sunit Gupta after hearing both the sides observed that , the report submitted by the prosecution clearly reflects that the aforesaid accused persons are the habitual offenders and they are continuously involved in drug business. With these observations, Court rejected the bail application.
