PIL on lack of basic facilities in Marwah-Warwan | Division Bench seeks response from govt | | ASIF IQBAL NAIK EARLY TIMES REPORT
JAMMU, Oct 15: In a Public Interest Litigation (PIL) filed by political and social activist Ghulam Rasool Magrey regarding the lack of basic facilities including proper road to Marwah Sub Division, the Division bench of Jammu and Kashmir High Court sought a reply from the government within two weeks and listed the case after two weeks for next hearing. As per the details available with Early Times, in Wp(c) PIL No. 26/2020 titled Ghulam Rasool Magray v/ s Union Territory of J&K and others was listed before Division Bench comprising of Chief Justice Gitta Mital and Justice Rajesh Bindal of High Court of J&K at Jammu. PIL filed by Ghulam Rasool Magray through his counsel advocate Nazim Qazi highlighted the sufferings of 28 thousand people of Marwah and Warwan, which are far flung areas of district Kishtwar. Advocate Nazim Qazi submits before the Division Bench that at a time when COVID-19 lockdown restrictions have been eased across the country, the people of hilly tehsil of Marwah in district Kishtwar have been subjected to further miseries by closing their vital road link of Sinthan, which connects them to Kishtwar. Advocate Qazi further submitted that the people of Marwah and Warwan who constitute a major section of population of district Kishtwar are being deprived of their basic right of livelihood and dignified life. “When MHA guidelines for Unlockdown-4 gave free access to people and goods in the entire country, these people who constitute more than 28 villages having a population of thousand have been barred to travel through Sinthan-Kishtwar road. These people have travelled all the way from Anantnag, Ramban, Doda and Kishtwar via Banihal highway covering more than 400 kms of journey which can be covered in few hours if Sinthan top is opened for commuters,” Qazi argued, adding that these poor people are deprived of genuine right to dignified life due to failure and utter dismay of district administration who have kept the road blocked for more than 5 months now. After hearing the arguments of Advocate Nazim Qazi, the Division Beach issued notices to the National Highways & Infrastructure Development Corporation through Executive Director (FFA) NHIDCL Jammu & Deputy Commissioner Kishtwar to submit status report with regard to the subject matter within two weeks’ time. Additional Advocate General Aseem Sawhney accepted the notice on behalf of the government. The matter has been again directed to be listed after two weeks.
