Four years on political migrant moves from pillar to post for retrieval of his property | ACR sits on file despite directions from Court, DC Srinagar | | Jehangir Rashid

SRINAGAR, Feb 19: For the past four years or so a political migrant has been making frequent rounds to the administrative offices so that his property taken over fraudulently at Azad Basti Natipora in Srinagar district is handed over to him, but till date justice has been denied to him. The political migrant Jan Mohammad Reshi has over the years moved multiple applications before the office of Deputy Commissioner for protection of his property. Although, the Deputy Commissioner has been cooperative in the case, but the other staff especially Assistant Commissioner Revenue (ACR) Srinagar has been given a cold shouldered response towards the same. In September last year Deputy Commissioner Srinagar, Dr. Shahid Iqbal Chaudhary had directed the ACR Srinagar to institute a case and issue notice after seeking report from the concerned Tehsildar. The ACR Srinagar did not deem it fit to follow the directions of Deputy Commissioner due to which the case is lingering on. It would be in place to mention here that Financial Commissioner (Revenue) had on 18-06-2019 directed the applicant (Jan Mohammad) to approach the Deputy Commissioner (District Magistrate) Srinagar with his complaint for redressal of the same contending that the District Magistrate is authorized to act in matters related to migrants. “Under Migrant Act, District Magistrate is an authorized person who within 30 days from commencement of Act is under the mandate of the statute to take possession of the immovable property belonging to migrants, falling within his territorial jurisdiction,” wrote the Financial Commissioner (Revenue) in the order. Although the Deputy Commissioner is under the mandate to redress the issues related to migrants within 30 days, Jan Mohammad has been moving from pillar to post so that his property is handed back to him. The ACR Srinagar seems to have made it a point to negate the directions of Deputy Commissioner, Srinagar. The applicant also knocked at the doors of High Court following which the Court ordered that the matter should be heard by District Magistrate, Srinagar with the directions that the final orders be passed within a time period of four weeks. The order was issued in November 2019 with action still pending. “All the parties involved in the matter were summoned by ACR more than 20 times and the statements were recorded. Right from November 2020 the matter is pending before the ACR without any reason. For the past four years I have been moving from pillar to post with no light at the end of the tunnel,” said Jan Mohammad while talking to Early Times. Jan Mohammad said his property has been encroached by some persons adding that the power of attorney of the property consisting of a house and 10 Marlas of land at Natipora was given in favour of Mohammad Yusuf Wagay. He said that Yusuf misused the same and executed a sale deed illegally in favour of one Mohammad Syed adding that property was sold to Bashir Ahmad Rather and Shakeel Ahmad Bhat on separate occasions. |
