Court rejects bail plea of police cop in rape case | | | Early Times Report
Jammu, May15: Additional Sessions Judge Kathua Kamlesh Pandit rejected the bail application of one Muhammad Arfan a police constable who committed the rape on the false assurance of marriage. The Additional Sessions Judge while rejecting the bail application observed that any sexual assault upon a woman is considered as the most heinous crime and dastardly acts having social, psychological, physical and emotional repercussions on the life and prospects of the victim. The social censure and social disgust of the offences of sexual assault has impelled our legislators to amend the laws dealing with these offences and make them more rigorous, sterner and more stringent. The judge observed that the new legislations have been enacted to deal with an iron hand and more effectively, the ever increasing intensity of incidents of sexual violence against women. He said the solemn duty is cast on the courts while exercising discretion in such cases to balance individual interest with the interest of the whole society at large. In this case, the accused person/applicant has committed very serious offence of rape on hapless prosrecutrix and is seeking pre arrest bail when the allegations are very serious and his innocence is not prima facie culled out. The judge said that more so the investigation is in progress and the release of the accused persons at this stage would definitely cause a dent in the investigation and also there is every apprehension that accused/applicant may repeat the offence or influence the witnesses. |
